The Respect for Marriage Act Does Not Codify Marriage Equality
There’s a lot of confusion around marriage equality right now, so here’s the skinny: The Respect for Marriage Act, signed into law by President Biden on December 13, 2022, does not codify the Supreme Court’s 2015 Obergefell v. Hodges decision, which granted LGBTQ+ couples the right to marry. Instead, it forces states without marriage equality laws to recognize LGBTQ+ marriages from other states. This means that if you marry in a state with marriage equality, your union will be recognized nationwide.
